Representative Mike Ezell

Dear [salutation],

Article I, Section 3 of the Constitution is clear: "The Senate shall have the sole power to try ALL impeachments." But when the House delivers articles of impeachment against DHS Secretary Alejandro Mayorkas today, Majority Leader Chuck Schumer may not hold a trial.

I believe the American people deserve accountability for Mayorkas's failure to enforce the law, and I believe the Senate must do its constitutional duty. Do you?  Please take a moment to fill out the survey below:

As a member of the House Committee on Homeland Security, I'm proud of the way we've handled these impeachment proceedings.

We didn't rush to judgement or create a partisan show trial like House Democrats did last Congress.

Instead, we conducted a thorough, nearly year-long investigation into Secretary Mayorkas's dereliction of duty.

As part of that investigation, I heard testimony from countless witnesses — law enforcement, immigration experts, victims of the border crisis, and more.

I visited the Southern Border, where I spoke directly with Border Patrol and ICE agents who are no longer able to do their jobs because of Mayorkas's refusal to enforce our immigration laws.

After all of this, the Homeland Security Committee considered articles of impeachment on January 30, 2024. In spite of Democrat stall tactics, we advanced those articles to the House floor, where they passed in February.

Before Secretary Mayorkas, no sitting cabinet member had ever been impeached — instead, they have chosen to resign before an impeachment.

But Mayorkas did not. He refuses to do his job, but he won't step aside and let some one serious take his place.

If Mayorkas won't resign and President Biden won't fire him for his dereliction of duty, impeachment and removal is the only answer. That's why the Senate MUST do its constitutional duty and hold a trial.

I'm grateful to Senate Republicans for holding the line on this issue and demanding that Schumer hold a trial. They recognize that the American people deserve answers.

The American people deserve to know why over 7.6 million illegal immigrants have been encountered at the Southern Border since Secretary Mayorkas took office — and why nearly a quarter of them (1.8 million) made it into the United States without being apprehended by Border Patrol.

They deserve to know why Secretary Mayorkas has pushed illegal mass parole programs that have let hundreds of thousands of foreign nationals into the country, including rapists and murderers.

They deserve to know why Border Patrol agents have been ordered to weld open massive gates in the Southern Border and remove barriers designed to prevent border crossings.

Unfortunately, Senate rules mean that Republicans alone cannot force an impeachment trial.

Senator Schumer has a choice to make. He can hold a trial and give the American people the answers and accountability they deserve, or he can put partisanship ahead of his constitutional duty and let Mayorkas evade justice.

I'm not optimistic about what he'll choose, but I pray I'm wrong.
